1. Scope

These General Terms and Conditions (GTC) apply to all deliveries from VLUV GmbH & Co. KG to consumers (§ 13 BGB).

3. Offer and Conclusion of Contract

3.1 The presentation of the products in the online shop does not constitute a legally binding offer, but rather an invitation to order. All offers are valid "while stocks last", unless otherwise stated for the products. Errors excepted.

3.2 By clicking the “Send order” button in the last step of the ordering process, you place a binding order for the goods contained in the shopping cart. The purchase contract is concluded when we accept your order by sending an order confirmation via email immediately after receiving your order.

 

4. Text of the Contract

The contract text is stored on our internal systems. You can view the general terms and conditions on this page at any time. The order details and the terms and conditions will be sent to you by email. After the order has been completed, the contract text is no longer accessible via the Internet for security reasons.

 

5. Right of withdrawal

Consumers (§ 13 BGB) have a legal right of withdrawal. 

Cancellation Policy

You can revoke your contractual declaration within 30 days of receipt of the goods without giving reasons in text form (e.g. letter, email). The period begins after receipt of this instruction in text form, but not before receipt of the goods by the recipient (in the case of recurring deliveries of similar goods, not before receipt of the first partial delivery) and also not before fulfillment of our information obligations in accordance with § 312c Paragraph 2 BGB in conjunction with § 1 Paragraph 1, 2 and 4 BGB-InfoV as well as our obligations in accordance with Section 312e Paragraph 1 Sentence 1 BGB in conjunction with Section 3 BGB-InfoV. To meet the cancellation deadline, it is sufficient to send the cancellation or the item in a timely manner.

Exclusion of Cancellation

The right of withdrawal does not apply to contracts:

1. for the delivery of goods that are manufactured according to customer specifications or that are clearly tailored to personal needs or that are not suitable for return due to their nature or that can spoil quickly or whose expiry date would be exceeded,
2. for the delivery of audio or video recordings (e.g. CDs and DVDs) or software, provided that the data carriers delivered have been unsealed by you.

If you are an entrepreneur within the meaning of Section 14 of the German Civil Code (BGB) and are acting in the exercise of your commercial or self-employed activity when concluding the contract, you do not have the right of withdrawal.

Consequences of Cancellation

If you cancel this contract, we will refund to you all payments received from you, including delivery costs (except for additional costs resulting from you choosing a method of delivery other than the cheapest standard delivery offered by us have) to be repaid immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment we use the same payment method that you used for the original transaction, unless something different was expressly agreed with you; under no circumstances will you be charged any fees as a result of this repayment. We may refuse repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is the earlier. You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you notify us of your cancellation of this contract. The deadline is met if you send the goods before the fourteen day period has expired.

You only have to pay for any loss in value of the goods if this loss in value is due to an inspection of the quality, your own properties and functionality of the goods are not due to the necessary handling of them.

Return Shipping costs

Orders with delivery to Germany:

The return is free of charge. Please register your return by E-mail: info@hockdesign.de

Orders with delivery to EU Schengen countries:

Return shipping is at the buyer's expense. Please simply contact us by email info@hockdesign.de and we will send you all the necessary documents.

The prerequisite for a refund of the purchase price is that the goods are in perfect, unused and complete condition. We reserve the right to evaluate the condition of the goods and claim any damage.

Orders with delivery to other European countries (non-Schengen) and third countries:

Return shipping is at the buyer's expense. Please simply contact us by email service@vluv.de and we will send you all the necessary documents.

The prerequisite for a refund of the purchase price is that the goods are in perfect, unused and complete condition. We reserve the right to evaluate the condition of the goods and claim any damage.

6. Prices and shipping costs

6.1 All prices stated in the VLUV GmbH & Co. KG online shop include 19% statutory VAT or, according to the address provided in the checkout, the VAT of the country of shipment.

6.2 The shipping costs depend on the quantity of goods ordered and the shipping method and will be clearly communicated to you before you submit your binding order. You can find further explanations on the delivery and shipping costs page.

 

7. Delivery, customs duties and import duties

7.1 Delivery takes place within Germany, other European countries and worldwide according to different shipping cost regulations.

7.2 The delivery time is 2-5 working days, outside Europe approx. 10-30 days. We will point out any different delivery times on the respective checkout page.

7.3 For export shipments abroad (non-Schengen Europe and other foreign countries), the goods are exported duties unpaid and without VAT. Import duties and taxes may apply when importing into the destination country. Please contact your local customs office in advance for further information.

VLUV GmbH & Co. KG has no influence on shipping problems from service providers or for special reasons of force majeure and does not entitle you to compensation.

 

8. Orders from companies from the European Currency Area (EEA)

This shop does not offer the possibility of carrying out orders from European companies that have a VAT identification number without VAT or refunding them using the "reverse charge procedure". We reserve the right to cancel and refund orders if the ordering company subsequently requests a refund. Once the goods have been dispatched, the possibility of free cancellation expires. Please send us an email to office@vluv.de if you would like to order from us using the “reverse charge procedure”. We will then process the order separately.

9. Retention of Title

The goods remain our property until full payment has been made.

10. Warranty

The warranty is provided in accordance with the statutory provisions. The warranty period is 24 months within Europe and 12 months outside Europe.
